These terms of service apply when you use technosult.co.za or buy services from Technosult (Pty) Ltd ("Technosult", "we", "us"). By using this website or accepting a quote from us, you agree to them.

Most of our services are also covered by a written quote, proposal, service level agreement or contract. If that document says something different from these terms, the signed document applies.

3. Using this website

You may use this website to learn about our services and to contact us. You agree not to:

  • use it for anything unlawful, or in a way that infringes anyone else's rights;
  • try to gain unauthorised access to the website, our servers or any connected system;
  • upload or send malware, or anything designed to disrupt or overload the website;
  • copy large parts of the website, or scrape it to collect contact details.

The website content, including text, images, logos and design, belongs to Technosult or its licensors. You may share links to our pages, but you may not reuse our content commercially without our written permission.

4. Information on this website

The information on this website is general and is not advice for your specific situation. We try to keep it accurate and up to date, but we do not guarantee that it is complete or free of errors.

Prices shown on the website are indicative and exclude VAT unless stated. Your quote sets out the price that applies to you, and is valid for the period stated on it.

5. Quotes and service agreements

We provide services on the basis of a written quote or agreement. A quote becomes binding when you accept it in writing, sign it, or issue a purchase order for it.

To help us deliver the services, you agree to:

  • give us accurate information and tell us promptly about changes;
  • give us reasonable access to your premises, systems and people when needed;
  • make sure you have the right to use any software, data or content you ask us to work with;
  • keep your own passwords and access credentials safe.

Delivery dates in a quote are our best estimate. We will tell you as soon as possible if a date is likely to change.

6. Fees and payment

You agree to pay the fees in your quote or agreement. Invoices are payable within the period stated on the invoice, and prices exclude VAT unless stated.

Monthly services, such as cloud backup, hosting and support, are billed in advance unless your agreement says otherwise. If an account is overdue, we may suspend the affected services after giving you written notice.

7. Hardware, software and third-party services

Some of what we supply comes from other companies, including hardware, software licences, connectivity, network, cloud and AI platforms. These are subject to the supplier's own terms and the manufacturer's warranty, which we pass on to you.

We are not responsible for outages or changes caused by those suppliers, but we will help you deal with them as part of our support.

8. AI services

AI tools and agents can produce output that is inaccurate, incomplete or out of date. You remain responsible for checking AI output before relying on it, particularly for legal, financial, medical or other professional decisions.

We configure AI services to handle your data as described in our Privacy Policy and your service agreement. We do not use your data to train shared AI models.

9. Intellectual property

Once you have paid in full, you own the deliverables we create specifically for you, such as custom documents, configurations and code, unless your agreement says otherwise.

We keep ownership of our existing tools, templates, methods and know-how. Where these form part of a deliverable, you receive a licence to use them for your own business.

10. Confidentiality

Each of us will keep the other's confidential business information confidential and use it only for the services. This does not apply to information that is already public, or that the law or a court requires us to disclose.

11. Privacy

Our Privacy Policy explains how we handle personal information under POPIA, including information we process on your behalf when delivering services.

12. Limitation of liability

To the extent the law allows:

  • the website is provided "as is", and we do not guarantee that it will always be available or free of errors;
  • we are not liable for indirect or consequential loss, such as loss of profit, revenue or business opportunity;
  • our total liability for any claim relating to a service is limited to the fees you paid us for that service in the 12 months before the claim arose.

Nothing in these terms limits our liability for fraud or gross negligence, or any liability that cannot be limited by law. If you are a consumer under the Consumer Protection Act 68 of 2008, nothing in these terms limits the rights that Act gives you.

13. Events beyond our control

We are not responsible for delays or failures caused by events we cannot reasonably control, such as load-shedding, power or network failures, natural disasters, civil unrest or the failure of a third-party supplier. We will let you know and do what we reasonably can to limit the impact.

14. Suspension and termination

Either of us may end a service as set out in the relevant agreement. We may suspend access to a service, after giving notice where practical, if it is being used unlawfully, threatens the security of our systems or other clients, or if the account is overdue.

15. Links to other websites

This website links to other sites, including our affiliated brands and social media pages. Those sites have their own terms, and we are not responsible for their content.

16. Changes to these terms

We may update these terms from time to time. The date at the top shows when they were last updated. Changes do not affect a signed agreement during its term unless both of us agree in writing.

17. Governing law and disputes

These terms are governed by the law of the Republic of South Africa. If a dispute arises, we will first try to resolve it with you in good faith. If that does not work, either of us may refer it to a South African court with jurisdiction.

18. Contact us

For questions about these terms, contact us on 072 88 11 639 or sales@technosult.co.za, or write to us at 12 Blair Road, Pinetown, 3610.
